The Code of Conduct (CoC) is a voluntary code of conduct of the association "Die Wirtschaftsauskunfteien e.V.". It is not a law. The CoC regulates the review and storage periods for personal data by credit agencies. It has been agreed with the German data protection supervisory authorities and approved by the Hessian Commissioner for Data Protection and Freedom of Information (HBDI). It binds the members of the association that have joined it - including SCHUFA - to the deadlines set out therein.
The most important innovation is the 100-day rule. This is the option to shorten the retention period from 36 to 18 months after settlement in the event of a one-off payment default under certain conditions. SCHUFA will apply the shortening rule from mid-December 2024.
