The General Data Protection Regulation (GDPR) provides for a wide range of transparency requirements and information obligations when reporting information to SCHUFA. These are initially aimed at companies with which consumers have a business relationship. Until the GDPR came into force, the transfer of data to SCHUFA was generally based on a SCHUFA clause to be signed by the customer, which contained consent to the transfer of data and an information section for the transfer of negative data.

To implement the requirements of the GDPR, the previous SCHUFA clause has been replaced by an information solution consisting of two parts:

  • dem sogenannten SCHUFA-Hinweis, mit dem der Vertragspartner den Kunden über die Übermittlung seiner Daten an die SCHUFA unterrichtet
  • einem ergänzenden SCHUFA-Informationsblatt, das eine umfassende Beschreibung der Datenverarbeitung bei der SCHUFA enthält und so den SCHUFA-Hinweis ergänzt

The following conditions apply for reporting outstanding claims to SCHUFA:

  • You must have received at least two written reminders after the due date; the first reminder must have been sent at least four weeks before the SCHUFA is notified,
  • You must have been informed in advance, but no earlier than at the time of the first reminder, of an imminent transmission to SCHUFA or a possible consideration of the claim in question by SCHUFA, and
  • You must not have disputed the claim at the time of registration.

Other possible conditions that can lead to an outstanding claim being reported to SCHUFA are

  • Die Forderung wurde durch ein rechtskräftiges oder für vorläufig vollstreckbar erklärtes Urteil festgestellt oder es liegt ein Schuldtitel nach Paragraph 794 der Zivilprozessordnung vor, oder
  • die Forderung wurde nach Paragraph 178 der Insolvenzordnung festgestellt und von Ihnen im Prüfungstermin nicht bestritten, oder
  • Sie haben die Forderung ausdrücklich anerkannt, oder
  • das der Forderung zugrundeliegende Vertragsverhältnis kann aufgrund von Zahlungsrückständen fristlos gekündigt werden und Sie wurden zuvor über die bevorstehende Übermittlung an bzw. über eine mögliche Berücksichtigung durch die SCHUFA unterrichtet.

These requirements are based on Section 31 (2) sentence 1 of the German Federal Data Protection Act (BDSG). At this point, it regulates the cases in which information about a service owed that has not been provided despite being due may be used by credit agencies for credit scoring.
