The case

Mr. F. contacted the SCHUFA ombudsperson and asked to have his entries deleted from the debtor register of the central enforcement court. Due to an incorrect entry made by his electricity provider, an unlawful seizure had occurred. The outstanding amount had since been paid by him.

The decision

The ombudsperson had the entries in question checked by SCHUFA. It turned out that these were rightly included in Mr. F.'s database. The ombudsperson therefore informed Mr. F. that SCHUFA stores the data from debtor directories as a mirror image of the official registers. The data relating to Mr. F. continued to be kept in the register of the enforcement court. Until it has been deleted there, it cannot be deleted at SCHUFA either. However, the ombudsperson advised Mr. F. to contact the bailiff directly with the file number and apply for deletion at the enforcement court.
