The case
Mr. S. contacted the SCHUFA ombudsperson and requested the deletion of an enforceable claim and all associated entries from a debt collection company. He stated that he had never received any mail from the company or the Stuttgart district court. In his entire life, he had never fallen into arrears and had never received any reminders. He had also not initiated the stated settlement of the claim. Nothing had been collected from his account or seized. The entries made no sense because nothing had happened that could have led to such entries. If required, he could also submit all account statements and prove all of this.
The decision
After examining the documents, Mr. S.'s request initially appeared to have no prospect of success. With the existence of a title, which the contractual partner was also able to present to SCHUFA, the registration requirements were met and the entries were therefore lawful. However, when contacting the debt collection company, it turned out that the claim had not been settled by Mr. S., but by Ms. M.. Both were registered at the same address. As a result, Mr. S.'s claim that he had never received any mail or a title appeared credible. Mr. S.'s former partner had made online purchases without his knowledge, but had initially not paid the invoices.
The SCHUFA ombudsperson informed Mr. S. that he would arrange for the entries to be deleted.
